Statement by Freedom Foundation CEO Regarding the Washington Supreme Court’s Decision to Stay “Unconstitutional” Ruling on Capital Gains Tax

“Today’s decision by the State Supreme Court to stay Judge Huber’s ruling on the capital gains income tax is extremely disappointing,” declared Freedom Foundation CEO Aaron Withe.

“While the decision from the Supreme Court should have given more consideration to the harm to taxpayers, the ruling simply gives the green light for the state to write rules the Department of Revenue claimed it needed to draft now, if the tax ultimately is lawful.

“Attorney General Bob Ferguson in his eagerness to soak taxpayers is creating a situation of chaos and confusion among Washingtonians preparing for the upcoming tax season.  As usual Ferguson is playing with house money.  It costs him nothing but the public’s tax dollars to fight the Washington constitution and the consistently expressed will of the people he is supposed to represent.

“We look forward to making our case before the Supreme Court in January, and we are confident the court will ultimately rule the tax unconstitutional,” concluded Withe.
