Freedom Foundation hails Louisiana’s new worker-protection bill

Legislation ends arbitrary opt-out windows, requires unions to tell workers membership is voluntary

Baton Rouge, LA  — The Freedom Foundation today applauded the Louisiana Legislature for passing Senate Bill 312, a measure that strengthens worker freedom by ensuring employees understand their rights before joining a union. 

The bill now awaits the signature of Gov. Jeff Landry.  

SB 312 makes clear that union membership in Louisiana is and always has been a choice. The legislation requires that workers who wish to opt out receive an immediate response to that request, eliminating the arbitrary opt-out windows that have left employees trapped in organizations they never intended to join. 

The bill also requires unions to tell workers upfront that joining is voluntary and assure them they cannot face discrimination based on their decision to join or not join a union. 

The Freedom Foundation has documented how high-pressure tactics, including captive-audience meetings designed to pressure workers into signing union cards, mislead workers about their rights. 

SB 312 directly addresses this problem.

“Joining a union is supposed to be a choice, but arbitrary opt-out windows and captive-audience meetings have given Louisiana workers a very different impression,” said Aaron Withe, Freedom Foundation CEO. “The Louisiana Legislature stood up to government unions and put workers first. Gov. Landry should sign SB 312 without delay.”

“Workers shouldn’t have to fight their way out of something they never joined in the first place,” added Rusty Brown, the Freedom Foundation’s special projects director. “SB 312 makes sure Louisiana employees know their rights from the start. We commend the legislature for getting this done.”
